1. About Us

​

1.1   eSIMGO.sg is a website (the “Website”), and eSIM GO is a mobile application (the “App”) which are operated by ISerious Pte. Ltd. (“we”, “us”, “our”). We are registered in the Republic of Singapore under the Unique Entity Number 202528193R.

1.2   These Terms of Service (“Terms”) govern your access to and use of our website, mobile application, and global data-only eSIM services (“Services”) provided by us. By accessing our website, downloading or using our mobile application, creating an account, or purchasing and activating any eSIM plan, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use our Services. These Terms apply to all users worldwide.

2. Agreement Between You and eSIM GO

​

2.1   These Terms are an agreement between you and us about your use of the information, software, products, and services contained in or available through the Website and App. Your access to and use of the Website and/or App is conditioned on your acceptance of and compliance with this Agreement. You using the Website and/or App constitutes your agreement to all the terms, conditions, and notices contained in these Terms.

2.2   You affirm that you are fully able and competent to enter the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.

3. Services for You

​

3.1   Our Services allow you to purchase and activate international, data-only eSIM profiles delivered on a roaming basis through licensed telecommunications network operators and partners. 

​

3.2   We do not issue local telephone numbers, do not provide domestic mobile subscriptions, and do not operate as a licensed telecommunications operator in the jurisdictions where connectivity is provided.

​

3.3   We act as a reseller and platform provider, enabling you to access mobile data connectivity in supported countries without issuing local telephone numbers or voice/SMS services. You acknowledge that our role is limited to providing access to such Services through our platform and that the underlying network performance is dependent on the telecommunications operators whose infrastructure is utilized.

4. Account Registration and Security

​

4.1   To use our Services, you must create an account and provide accurate and complete information reasonably required to establish and maintain your account, process payments, and deliver the Services.

​

4.2   We do not generally require users to provide government-issued identification documents or national identity numbers to use roaming-based eSIM services, unless such verification is explicitly required by applicable law or by licensed telecommunications network operators involved in service delivery.

​

4.3   Where identity verification is required by law, such verification is conducted by the relevant telecommunications operator or its authorized verification partner in accordance with applicable local laws. We do not independently collect or retain government-issued identity documents unless expressly required by law.

​

4.4   Personal data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms. By using the Services, you acknowledge that personal data may be processed and transferred internationally in accordance with applicable data protection laws, including the Singapore Personal Data Protection Act and the General Data Protection Regulation.

4.5   Users may request access to personal data associated with their account in accordance with our Privacy Policy. Requests are subject to applicable legal requirements, identity verification, and reasonable limitations for security and operational reasons.

4.6   You agree to maintain the confidentiality of your account credentials and are responsible for all activities conducted under your account. If you believe your account has been compromised, you must notify us immediately. We reserve the right to refuse registration, suspend accounts, or terminate access where we believe our Terms, applicable laws, or fair usage rules have been violated.

4.7   Users may request deletion of their account in accordance with our Privacy Policy. Account deletion is permanent and may result in the loss of access to services and records. Certain data may be retained as required by law or for legitimate business purposes.

5. Your Obligations and Acceptable Use

​

5.1   Your use of our Services must comply with all applicable laws and industry regulations in the countries where the Services are used. You agree not to use the Services for any unlawful, fraudulent, abusive, or harmful purpose, including but not limited to interference with telecommunications networks, unauthorized reselling, cybersecurity breaches, or activities that violate sanctions or export-control laws. Any such misuse may result in immediate suspension or termination of your access without refund and may be reported to relevant authorities.

6. Purchases and Activation

​

6.1   The provisions of this Clause 6 apply subject to mandatory consumer protection laws applicable in the user’s country of residence.

​

6.2   This Agreement shall commence upon your successful purchase of an eSIM and applicable data plan through our website or mobile application.

​

You acknowledge that the eSIM constitutes a digital service that is made available immediately after purchase. Downloading the eSIM and activating the data plan requires a compatible device and a stable internet connection.

​

6.3   Upon successful payment, you will receive instructions to download, install, and activate your eSIM profile. 

​

The data plan will commence upon activation, which may occur automatically or upon first use, depending on the plan purchased. Downloading the eSIM and activating the data plan requires a stable internet connection.

It is your responsibility to ensure that your device is eSIM-compatible and unlocked. We are not liable for failures resulting from incompatible devices, incorrect user installation, insufficient coverage, or changes to local carrier networks. Data validity periods, speeds, and coverage maps are approximate and may vary by country or operator.

7. Duration, Renewal, and Termination

​

7.1   The Agreement shall remain in effect until the earlier of:

a) expiry of the data plan period selected at purchase; or

b) full consumption of the data allowance associated with the data plan,in accordance with the specifications disclosed prior to purchase.

​

7.1.1   Certain data plans may offer an optional automatic renewal feature, which allows a new data plan of the same type to be purchased automatically when the remaining data balance of the active plan falls below ten percent (10%).

​

7.1.2   Automatic renewal is disabled by default and will only apply if you have expressly enabled the renewal option for the specific eSIM plan through your account settings.

​

You may enable or disable the automatic renewal option at any time through your account settings. Changes to the renewal setting will apply to future renewal events only.

​

7.1.3   Where automatic renewal is enabled, you authorize us to charge the saved payment method associated with your account for the renewal amount at the time the renewal is triggered.

​

7.1.4   Automatic renewal will only occur if the data allowance is depleted before the expiry of the plan’s validity period. 

​

If the validity period of the data plan expires before the data allowance is fully consumed, the plan will not be renewed, and the service will terminate in accordance with Clause 7.1.

​

7.1.5   We will make reasonable efforts to display renewal status and upcoming charges within your account or prior to renewal, subject to technical and platform limitations.

​

7.2   The eSIM may remain installed on your device after the data plan has expired or been fully consumed.

You may remove the eSIM from your device at any time via device settings. However, removal of the eSIM may prevent further use of the service and may require the purchase of a new eSIM or data plan.

​

7.3   This Agreement shall terminate automatically and without notice upon the occurrence of any of the following events:

a) expiry or full consumption of the data plan in accordance with clause 7.1(a); or

b) suspension or termination of access to the eSIM or data plan due to a material breach of these Terms or applicable laws.

​

7.4   Upon termination pursuant to clause 7.3(a), any eSIM remaining on your device is provided on an “as is” and “as available” basis, without any warranty of continued functionality or service availability.

Termination does not affect any statutory consumer rights that cannot be excluded under applicable EU or UK consumer protection laws. Refund rights, if any, are governed by our Refund & Cancellation Policy.

7.5   Activation and continued availability of Services may be subject to regulatory, network, or localization requirements applicable to the telecommunications operators providing connectivity in the relevant jurisdiction.

8 Service Availability and Performance

​

8.1   We take reasonable measures to maintain continuous availability of our website and mobile application; however, we do not guarantee uninterrupted access.

​

8.2   Network outages, roaming restrictions, maintenance activities, or issues affecting third-party telecommunications operators may result in temporary service interruptions. We will not be liable for any loss arising from such interruptions, although we will make reasonable efforts to restore functionality promptly. 

​

8.3   You acknowledge that mobile data quality depends on factors beyond our control, including local network conditions, device compatibility, and geographic variables.

​

8.4   We may be required to suspend, restrict, or discontinue Services in certain jurisdictions where mandated by law, regulatory authorities, or telecommunications network operators.

9 Fees, Payments, and Billing

​

9.1   Payments for services will be processed in the currency selected by the user through the application or website settings. The selected currency will apply at the time the transaction is initiated and will govern all charges related to that transaction. 

​

9.2   Taxes and any applicable extra fees are not included in the prices reflected for our Services. These may be added based on your billing address when you make a payment.

​

9.3   We may adjust prices, introduce new charges, or modify billing practices at any time, subject to notice where required by law. Payments are processed through third-party payment service providers, and by completing a transaction you authorize such providers to process your payment information securely. If you believe a charge is incorrect, you must notify us promptly so that we may investigate.

10 Fair Use Policy (Data-Only eSIM Services)

​

10.1   This Fair Use Policy (“FUP”) is intended to ensure that all users of our global data-only eSIM services enjoy reliable, stable, and equitable access to mobile data connectivity. Because our Services rely on shared telecommunications infrastructure, improper or excessive usage may adversely affect network performance for other users. By using our Services, you agree to adhere to the principles set out in this policy.

10.2   Our data plans are intended for personal, non-commercial use. Activities such as tethering large volumes of traffic, operating servers or hotspots for multiple users, using automated systems to generate disproportionate data loads, or otherwise consuming network resources in a manner inconsistent with typical consumer behavior may be considered misuse. 

​

10.3   We reserve the right to monitor usage patterns through aggregated or technical data, always in accordance with applicable privacy and data protection laws and our Privacy Policy.

10.4   If your data consumption is found to exceed reasonable levels or disrupt network performance, we may take corrective measures that may include reduced speeds, temporary service restrictions, suspension of your account, or termination of the affected eSIM plan. In severe cases, misuse may result in permanent account closure without refund. Our determination of unfair usage will consider network conditions, individual usage patterns, and our obligations to telecommunications partners.

10.5   We may amend this Fair Use Policy from time to time to reflect evolving network requirements, technological changes, or regulatory obligations. Continued use of our Services after such updates constitutes your acceptance of the revised policy.

11 Jurisdictional and Regulatory Limitations

​

11.1   The availability, activation, and continued provision of the Services may vary by country due to local laws, regulatory requirements, or decisions by telecommunications operators or authorities.

11.2   In certain jurisdictions, licensed telecommunications network operators may be required to process or store certain categories of data locally to comply with applicable law. Where such requirements apply, they are satisfied by those operators in accordance with local legal obligations.

11.3   We reserve the right to restrict, suspend, or terminate Services in any jurisdiction where continued provision would expose us or our partners to legal or regulatory risk.

12 Refund and Cancellation Policy

​

12.1   This Refund and Cancellation Policy explain the circumstances under which refunds, cancellations, or adjustments may be granted for purchases made on our website or mobile application. All users are encouraged to read this policy carefully before purchasing or activating any eSIM service.

12.2   As our eSIM products are delivered digitally and become accessible immediately upon purchase, all sales are generally considered final once the eSIM activation details, QR code, or installation instructions have been issued to you. We therefore cannot offer refunds in cases where the eSIM has been delivered and is technically usable, even if you have not installed or activated it.

​

12.3   Refund requests may only be considered under certain limited conditions, such as when the purchased eSIM profile cannot be installed due to a verified technical fault attributable to our system, or when network connectivity is entirely unavailable in a country that is listed as supported for the plan you purchased. In such cases, we may investigate the issue with our telecommunications partners to determine whether a genuine failure has occurred. If we confirm that the problem is caused by factors within our control and cannot be remedied, we may, at our discretion, issue a refund or credit.

12.4   No refunds will be provided if the failure arises from device incompatibility, including but not limited to the use of eSIM-incompatible or network-locked devices, incorrect installation by the user, deletion of an installed eSIM, insufficient coverage due to local environmental conditions, changes in foreign network operator policies, or incorrect selection of a plan or region by the user. We strongly advise customers to verify device compatibility and country support before completing a purchase.

12.5   Requests for cancellations or refunds must be submitted through our customer support channels within a reasonable time after purchase. We may require evidence such as screenshots, error messages, or diagnostic logs to assess the issue. Our determination of refund eligibility is final. If a refund is approved, it will be processed through the original payment method within a commercially reasonable timeframe, subject to the policies of our payment service providers.

13 Intellectual Property

​

13.1   All intellectual property associated with our website, mobile application, trademarks, logos, content, and underlying software belongs to us or our licensors. You are granted a limited, non-exclusive, non-transferable license to use our platform solely for personal, lawful purposes. You must not reproduce, modify, distribute, reverse engineer, or create derivative works of any part of our Services without our express written consent. Unauthorized use may result in suspension, legal action, or both.

14 Disclaimer of Warranties

​

14.1   The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties relating to merchantability, fitness for a particular purpose, non-infringement, network reliability, or the accuracy of coverage information. We do not guarantee minimum data speeds or continuous network availability. Your use of the Services is at your own risk.

15 Limitation of Liability

​

15.1   To the maximum extent permitted by law, we exclude all liability for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, data, or business opportunities, arising from or related to your use of our Services. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Services will not exceed the total amount paid by you for the affected eSIM plan or service, regardless of the cause or basis of the claim.

15.2   Without limiting the foregoing, we shall not be liable for service interruptions, data loss, or performance limitations arising from regulatory actions, localization requirements, or acts or omissions of third-party telecommunications network operators.

16 Indemnification

​

16.1   You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, or expenses arising out of your violation of these Terms, your misuse of the Services, or your infringement of any rights of third parties. This indemnity survives the termination of your account or your use of the Services.

17 Modifications to the Terms

​

17.1   We reserve the right to modify these Terms at any time to reflect changes in our business practices, technological developments, or legal requirements. Any amended Terms will be published on our website and within our mobile application, and the date of the latest revision will be displayed. Continued use of the Services after the updated Terms are posted constitutes acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the Services.

18 Country Note

​

18.1   In certain countries, including China, Vietnam, and Russia, local telecommunications or data protection laws may impose specific requirements on network operators. The Services are provided in those jurisdictions on a roaming basis, and compliance with such requirements is handled by licensed telecommunications partners.

19 Governing Law and Dispute Resolution

​

19.1   These Terms and any dispute or claim arising out of or in connection with them or the Services shall be governed by the laws of Singapore.

​

19.2   Where you are a consumer, nothing in these Terms limits any rights you may have under mandatory consumer protection laws, including the right to bring proceedings in your local courts where required by law.

​

19.3   Subject to the foregoing, any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Singapore.

​

19.4   Notwithstanding the above, we may elect to refer disputes arising from business-to-business relationships to arbitration administered by the Singapore International Arbitration Centre (SIAC), with the seat of arbitration in Singapore and proceedings conducted in English.
